Canadian sent to jail for molesting minor

KATHMANDU: Lalitpur
District Court has sent an a Canadian national to Nakhkhu Jail to proceed with
further investigation into his alleged involvement in committing unnatural sex
with an underage boy.
DSP Pawan Kumar Giri, Spokesperson for the Metropolitan Police Range, Jawalakhel,
which received a complaint from the victim’s family, said Ernest Fenwick
Macintosh (passport no BA453249), 71, of Guysborough, Canada had allegedly
forced the minor into having unnatural sex with him at Machhindra Marg,
Lalitpur-20, on December 13. The boy is said to be from Achham, currently
staying at a children’s home in Lalitpur.
The complaint was lodged with the MPR on December 19, stating that the Canadian
tourist lured the minor into his rented room at Cafe Brazil Guest House and
Coffee Shop, Machhindra Marg before engaging in unnatural sex with the boy at
around 11.30 am.
According to Number 9(A) of Chapter 14 of Muluki Ain (General Code), a person
who commits or causes to be committed sodomy (any kind of unnatural sexual
intercourse) with a minor, it shall be considered to be an offence of rape and
the offender shall be liable to nine to 13 years of imprisonment. The court will
also make an order to provide appropriate compensation to such a minor from the
offender, upon considering the age and grievance suffered by the minor.
DSP Giri informed that the MPR had demanded maximum punishment against the
accused as per the existing law. “Finally, the court sent Macintosh, the alleged
child molester, to the jail to proceed with further investigation,” he said.
